Can A Landlord Use An Old Eviction Notice?

Renting in Dubai should be done with proper understanding of the prevailing law that applies in tenant-landlord relationships. Standard procedure states that the landlord should present the eviction notice via registered mail or via legal services to the tenants with a 12 month notice period. This allows the tenants to deal with the moving, finances and other affairs they should get in order. In the eviction notice the landlord / owners should clearly mention a valid reason for the eviction for it to be valid. The reasons can include the sale of the property, renovation or for personal use. But any verbal or any other non-notarised notices are not valid.

Property transfers happen between owners while the tenants carry on with their tenancy. In such cases, previous eviction notices’ validity cease to exist with the transfer of the ownership. If the new landlord / owner wants the tenants to be evicted, previous eviction notices cease to be valid and the new owners should prepare a fresh eviction notice with the standard notice period. This is a right that the tenants have in Dubai, protecting families from unfair eviction.

Even if the eviction notice offers the accepted notice period of 12 months, the owners cannot evict the current tenant solely for re-letting their property for a higher rent. The evictions should be under legitimate reasons and rent-increases can be addressed at the end of the tenancy agreement, so the tenants may agree if they wish to proceed. But if the landlord has not served the tenants with an eviction notice, the end of the agreement period doesn’t mean that the tenants will have to move-out, according to the law, if the tenants have not received a notice for eviction, they will have to renew the current agreement.
